The Santa Clara County District Attorney is expected to file charges against the teenager arrested in connection with the triple-shooting Friday at Valley Fair mall.
The 17-year-old suspect could be charged as an adult, a move District Attorney Jeff Rosen says his office is considering. The teen is accused of shooting three people at Valley Fair on Black Friday.
The DA’s Office is expected to file charges Wednesday.
“The options in terms of time are anywhere from the rest of his life in adult prison to a couple of months at the juvenile ranch or juvenile hall, so the options are quite broad in terms of what a judge can do,” Rosen said.
San Jose police arrested the suspect late Sunday, as well as a woman they believe helped the teen get away from the mall.
According to police, the shooting started as a conflict between two different groups at the mall. The 17-year-old suspect seemed to think the person he allegedly shot was a rival gang member, police said. Two other people who happened to be passing by also were shot.
The suspected shooter already is on probation, police said Monday.
“In February of this year, this suspect fled from San Jose PD gang enforcement officers and was found to have a loaded gun in his waistband,” Chief Paul Joseph said. “The suspect’s case resulted in a deferred entry of judgment.”
The woman arrested was pushing a baby in a stroller when the shots were fired, police said. She will be charged with allowing and facilitating the escape of the shooter from the scene, the DA said. Her exact connection to the alleged gunman is unclear.
