Case of babies' 2023 overdose deaths in San Jose back in court

The case against two men in San Jose accused in the overdose deaths of two babies in 2023 is in court Monday.

The babies died from fentanyl overdoses just a few months apart, one named Baby Phoenix, the other Baby Winter.

David Castro, Phoenix’s father, and Phillip Ortega, who allegedly provided the drugs, are set to appear in court for a preliminary hearing. Both have pleaded guilty to charges.

Baby Winter’s parents, Derek Rayo and Kelly Richardson, became the first in Santa Clara County history to be charged with murdering their own child with drugs.

The cases are connected because Ortega was the drug dealer for both.
